Acceptance of the Terms of Use

These Terms of Use are entered into by and between you and Source7 Inc. ("Company," "we," or "us") and govern your access to and use of the Appliance911.ai and/or Appliance411.ai website and services (collectively, the "Services"), including any content, features, or functionality offered through the Services, whether as a guest or registered user. The Services include, without limitation, the submission of appliance and personal information to receive appliance risk assessments.

By using the Services, or clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy, available at https://www.appliance911.ai/privacy-policy, which is incorporated by reference. If you do not agree, you must not use the Services.

The Services are intended for users who are at least 16 years old and located in the United States or its territories. By using the Services, you represent that you meet these requirements. You further represent that you are the owner or authorized occupant of the residence for which you submit appliance information, or that you have authorization from the owner or occupant to do so.

Changes to the Terms

We may update these Terms of Use at any time in our sole discretion. Changes take effect immediately upon posting and apply to all future use of the Services. However, changes to dispute resolution provisions do not apply to disputes of which the parties had actual notice before the change was posted. Your continued use of the Services means you accept the updated Terms. Please check this page regularly for updates.

Access and Account Security

We may change or withdraw the Services, or restrict access, at any time without notice. We will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Services, or the entire Services, to users, including registered users.

You are responsible for: (a) making necessary arrangements to access the Services; and (b) ensuring that anyone accessing the Services through your internet connection is aware of and complies with these Terms. To use the Services, you may be asked to provide certain registration or other information, including personal information such as your name, email address, zip code, and street address, as well as information about your appliances (such as age, make, model, and barcode or serial number). You agree that all such information is accurate, current, and complete, and will be handled in accordance with our Privacy Policy.

If you are given a username, password, or other login information, you must keep it confidential. Your account is personal and should not be shared. You agree to notify us immediately of any unauthorized use or any other breach of security. We may disable any login credentials at our discretion, including if, in our sole discretion, you have violated these Terms.

Intellectual Property

All content, features, and functionality (including all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) of the Services are owned by the Company or its licensors and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. All risk assessment models, scoring algorithms, data models, and analytical methodologies used in the Services are proprietary to the Company. You may use the Services for personal, non-commercial use only.

You may not reproduce, distribute, modify, or create derivative works from, publicly display, republish, download, store, or transmit our content except:

• Temporary storage in RAM as part of normal browsing.
• Automatic browser caching for display enhancement purposes.
• Printing or downloading a reasonable number of pages for personal, non-commercial use, but not for further reproduction, publication, or distribution.
• Downloading any applications we provide, subject to applicable license terms.
• Using any social media features we may provide.

You must not:

• Modify or separate materials from their context in the Services.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from these Services.
• Use the Services or content for commercial purposes without permission.

Trademarks

The Company name, the terms "Appliance911," "Appliance911.ai," "Appliance411," "Appliance411.ai" and "Source7," and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You may not use them without our prior written consent.

Prohibited Uses

You agree to use the Services only for lawful purposes and not:

• In any way that violates any applicable federal, state, local, or international laws or regulations.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit any advertising or promotional material without our prior written consent.
• To impersonate the Company, a Company employee, another user, or any other person or entity.
• To overload or disrupt the Services or related systems.
• To introduce any viruses, Trojan horses, worms, logic bombs, or other malicious material.
• To attempt unauthorized access to any part of the Services.
• To submit false, misleading, or fabricated appliance information through the Services.
• To submit appliance or personal information for a residence you do not own, occupy, or have authorization to act on behalf of.
• To use the risk assessment results for any commercial purpose, including resale or redistribution, without our prior written consent.
• To scrape, harvest, or systematically collect data or content from the Services.

Third-Party Terms

The Services may link to or incorporate features, software, or services provided by third parties. After you submit your information through the Services, third-party fulfillment providers (such as appliance retailers, repair companies, or home warranty providers) may contact you based on the information you have provided and your risk assessment results. Your interactions with such third parties are governed by their own terms and policies, not ours.

Consent to Data Sharing and Third-Party Contact

By using the Services and submitting your information, you acknowledge and agree that:

• We will use the appliance information and personal information you provide to generate risk assessments and for the other purposes described in our Privacy Policy.
• We may share your personal information and risk assessment results with third-party fulfillment providers, including but not limited to appliance retailers, repair companies, and home warranty providers, who may contact you regarding relevant products or services.
• We may use your information, in combination with information from other users, to develop, improve, and refine our risk assessment models and related products and services.
• Your information may be retained and used as described in our Privacy Policy even after you stop using the Services.

To the extent permitted by applicable law, you may opt out of the sale or sharing of your personal information as described in the Privacy Policy.

Risk Assessments and Informational Purposes

The risk assessments and scores provided through the Services are for general informational purposes only. They are generated by proprietary models based on the appliance information you submit and other available data. Risk assessments are not guarantees, warranties, predictions, or professional opinions regarding the condition, safety, remaining useful life, or insurability of any appliance.

We do not guarantee the accuracy, completeness, or reliability of any risk assessment. We are not responsible for any decisions you make, or any actions you take or fail to take, based on a risk assessment.

Disclaimer of Warranties

Your use of the Services, including any risk assessments generated through the Services, is at your own risk. We provide the Services "as is" and "as available," without any warranties of any kind. TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any damages arising from your use of or inability to use the Services, any risk assessment provided through the Services, any actions taken by third-party fulfillment providers, or any content linked through the Services, including direct, indirect, special, incidental, consequential, or punitive damages. Our total aggregate liability for any claims arising out of or relating to the Services shall not exceed one hundred dollars ($100.00).

Indemnification

You agree to defend and indemnify the Company, its affiliates, and service providers from any claims or damages arising from your violation of these Terms, your use of the Services, any reliance on risk assessments provided through the Services, any interactions with third-party fulfillment providers, or your use of any information obtained from the Services.

Miscellaneous

• Governing Law: All matters relating to the Services and these Terms shall be governed by the laws of the State of Michigan. Any legal proceedings shall be instituted exclusively in the federal or state courts of Michigan.
• Arbitration: At Company's sole discretion, we may require you to submit any disputes arising from these Terms to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Michigan law.
• Limitation on Claims: Any cause of action or claim arising out of or relating to these Terms or the Services must be filed within one year of when the cause of action accrues.
• Waiver and Severability: No waiver by the Company of any term shall be deemed a continuing waiver. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
• Entire Agreement: These Terms and our Privacy Policy are the entire agreement between you and the Company regarding the Services.
